1. Overview
Welcome to ConsTru. These Terms & Conditions ("Terms") govern your access to and use of the ConsTru website, mobile application, Delivery Partner App, and all products, services, features, and content provided by ConsTru. By accessing or using our platform, creating an account, placing an order, or using any of our services, you acknowledge that you have read, understood, and agreed to be bound by these Terms, our Privacy Policy, Return & Refund Policy, Shipping Policy, and any other policies published by ConsTru. If you do not agree with these Terms, please do not use our platform or services.
2. About ConsTru
ConsTru is an online platform that facilitates the purchase and delivery of construction materials and, where available, enables users to book construction-related services. ConsTru may work with manufacturers, distributors, suppliers, logistics providers, delivery partners, and independent service professionals to facilitate these services.
3. Eligibility
You must be at least 18 years of age and legally capable of entering into binding contracts under applicable laws to use our platform. By using ConsTru, you represent and warrant that all information provided by you is true, accurate, complete, and up to date.
4. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activities carried out through your account. ConsTru may suspend, restrict, or terminate your account without prior notice if false information, fraudulent activity, misuse, unauthorized access, suspicious transactions, or violation of these Terms is detected.
5. Orders, Pricing & Payments
All orders placed through ConsTru are subject to product availability, verification, and acceptance. ConsTru reserves the right to refuse, modify, limit, or cancel any order at its sole discretion due to stock unavailability, pricing errors, technical issues, suspected fraud, payment failures, incorrect information, duplicate orders, or any operational reason. Product prices, offers, discounts, availability, and specifications may change without prior notice. Payments must be completed through approved payment methods before order processing unless otherwise agreed. Applicable taxes, including GST, shall be charged as per Indian law.
6. Delivery
Delivery timelines displayed on the platform are estimates only and may vary due to stock availability, weather conditions, traffic, supplier delays, transportation issues, government restrictions, public holidays, force majeure events, or circumstances beyond the reasonable control of ConsTru. Users are responsible for providing complete and accurate delivery information. Risk and responsibility for the products shall pass to the customer upon successful delivery at the specified delivery location. Customers are advised to inspect products upon delivery and report any visible damage, shortage, or incorrect product within the timeline specified in the Return & Refund Policy.
7. Cancellation, Returns & Refunds
Order cancellations, returns, replacements, and refunds shall be governed by the ConsTru Return & Refund Policy. Certain products, including customized, special-order, perishable, damaged-by-use, or non-returnable items, may not be eligible for cancellation or refund. Refund timelines may vary depending on payment providers and banking institutions.
8. Products & Services
ConsTru makes reasonable efforts to ensure that product descriptions, specifications, pricing, availability, images, dimensions, technical information, and other details are accurate. However, product images are for illustrative purposes only, and actual products may vary in colour, packaging, branding, finish, size, specifications, or appearance due to manufacturer updates or display settings. Product warranties, where applicable, are provided solely by the respective manufacturers unless expressly stated otherwise. Users are solely responsible for verifying that products are suitable for their intended purpose before purchase, installation, or use. Construction-related information available on the platform is provided for general informational purposes only and shall not be considered engineering, architectural, structural, legal, financial, or professional advice.
9. Construction & Professional Services
Where ConsTru facilitates bookings for plumbers, electricians, painters, masons, contractors, architects, engineers, consultants, or other professionals, such services are provided by independent third-party service providers unless expressly stated otherwise. ConsTru acts solely as a technology platform facilitating such bookings and shall not be responsible for workmanship, project delays, quality of work, negligence, contractual disputes, warranties, or liabilities arising from services performed by independent professionals.
10. Delivery Partner App
Delivery partners using the ConsTru Partner App consent to the collection and processing of location information, including background location where required, solely for order assignment, navigation, live tracking, delivery verification, distance calculation, earnings calculation, fraud prevention, operational monitoring, and customer support. Delivery partners are responsible for complying with applicable traffic laws, maintaining valid licences, insurance, permits, and vehicle documents, and ensuring the safe handling of customer orders. ConsTru reserves the right to suspend or terminate any partner account for fraudulent activity, repeated delivery failures, misconduct, misuse of the platform, or violation of these Terms.
11. Prohibited Activities
Users shall not misuse the platform, provide false or misleading information, attempt unauthorized access, interfere with platform security, upload malicious software, engage in fraudulent transactions, violate applicable laws, infringe intellectual property rights, scrape or copy platform data, misuse promotional offers, impersonate others, or use the platform for unlawful, harmful, abusive, or unauthorized purposes. ConsTru reserves the right to investigate suspected violations and take appropriate legal or technical action.
12. Intellectual Property
All trademarks, logos, software, source code, content, graphics, product listings, designs, databases, text, images, videos, documents, and other materials available on the ConsTru platform are owned by or licensed to ConsTru and are protected under applicable intellectual property laws. No content may be copied, reproduced, distributed, modified, published, reverse engineered, or commercially exploited without prior written permission from ConsTru.
13. Third-Party Services
ConsTru may integrate with third-party payment gateways, logistics providers, manufacturers, suppliers, mapping services, communication providers, analytics platforms, cloud service providers, and other technology partners. ConsTru does not own or control such third-party services and shall not be responsible for their availability, performance, security, accuracy, warranties, delays, interruptions, acts, omissions, or failures, except where liability cannot be excluded under applicable law.
14. Disclaimer
To the fullest extent permitted by applicable law, the ConsTru platform, website, mobile applications, products, services, and content are provided on an "AS IS" and "AS AVAILABLE" basis without any express or implied warranties. ConsTru does not warrant uninterrupted availability, error-free operation, complete accuracy of information, compatibility with all devices, or that defects will always be corrected. Product warranties, if any, are provided solely by the respective manufacturers or suppliers unless expressly stated otherwise.
15. Limitation of Liability
To the maximum extent permitted by applicable law, ConsTru, its directors, officers, employees, affiliates, licensors, suppliers, manufacturers, contractors, delivery partners, logistics partners, service providers, and agents shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to loss of profits, revenue, goodwill, business interruption, project delays, construction losses, data loss, or any other commercial damages arising from the use of the platform, products, services, website, mobile application, Delivery Partner App, third-party services, manufacturer defects, supplier delays, logistics delays, pricing errors, technical failures, internet interruptions, force majeure events, or user negligence. Where liability cannot legally be excluded, ConsTru's total aggregate liability shall not exceed the amount actually paid by the customer to ConsTru for the specific order giving rise to the claim.Nothing in these Terms shall limit or exclude any liability that cannot be limited or excluded under applicable law.
16. Indemnification
You agree to defend, indemnify, and hold harmless ConsTru, its directors, officers, employees, affiliates, licensors, suppliers, contractors, logistics partners, delivery partners, service providers, and representatives from and against any claims, liabilities, damages, losses, costs, penalties, expenses, or legal fees arising out of your misuse of the platform, violation of these Terms, infringement of third-party rights, violation of applicable laws, fraudulent activities, or negligence.These obligations shall survive the suspension, termination, or closure of your account and the discontinuation of your use of the ConsTru platform.
17. Privacy
Your use of the ConsTru platform is also governed by our Privacy Policy, which forms an integral part of these Terms.
18. Changes to Terms
ConsTru reserves the right to modify, update, or replace these Terms at any time without prior notice. Updated Terms shall become effective immediately upon publication on the platform. Continued use of the platform constitutes acceptance of the revised Terms.
19. Governing Law & Jurisdiction
These Terms shall be governed by and interpreted in accordance with the laws of India. Any disputes arising from or relating to these Terms or the use of the ConsTru platform shall be subject to the exclusive jurisdiction of the competent courts located in Nagpur, Maharashtra, India.
20. Entire Agreement & Severability
These Terms, together with the Privacy Policy, Return & Refund Policy, Shipping Policy, and any other policies published by ConsTru, constitute the complete agreement between you and ConsTru regarding the use of the platform and supersede any prior communications or understandings relating to the same subject matter. If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain valid and enforceable to the fullest extent permitted by applicable law. Any failure or delay by ConsTru in enforcing any provision of these Terms shall not constitute a waiver of such provision or any other rights.
21. Acceptance of Terms
By accessing or using the ConsTru website, mobile application, Delivery Partner App, or any services offered by ConsTru, you acknowledge that you have read, understood, and agreed to be bound by these Terms & Conditions and all related policies published by ConsTru.
